1. ACCEPTANCE OF TERMS

By accessing the website at [FieroGlow URL], purchasing products, or engaging with our services, you agree to be bound by these Terms of Service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. SAFETY & LIABILITY DISCLAIMER (READ CAREFULLY)

FieroGlow apparatus are Scientific Display Devices, not consumer toys. By purchasing from FieroGlow, you acknowledge and accept the inherent risks associated with High-Voltage (HV) and Radio Frequency (RF) technology.

• Not a Luminaire: These devices are intended for educational, artistic, and demonstration purposes only. They are not intended for general room illumination.

• High Voltage / RF Hazard: Our Toroidal Inductively Coupled Plasma (TICP) drivers operate at high voltages and radio frequencies. While shielded, misuse can result in RF burns, electrical shock, or fire. You agree to use these devices solely in accordance with the FieroGlow Safety Protocols provided with your unit.

• Thermal Hazard: Glass surfaces may exceed 140°F (60°C) during operation. You agree to utilize the provided Thermal Wool Interface and avoid prolonged contact with active glass.

• Optical Hazard: Certain gas mixtures (Sodium, Barium) produce High-Intensity Discharge (HID) light. You acknowledge the recommendation to use appropriate eye protection (Didymium or Shade 3 glasses) as specified in the product description.

• Medical Interference: You agree NOT to operate these devices within 10 feet of sensitive medical equipment, including but not limited to pacemakers, insulin pumps, or hearing aids.

LIMITATION OF LIABILITY: To the fullest extent permitted by law, FieroGlow LLC shall not be liable for any injury, property damage, or loss resulting from the misuse, modification, or improper handling of our products. 

You are the operator; you hold the fire.

3. THE NATURE OF THE ART (PRODUCT VARIANCE)

• Handmade Variance: You acknowledge that FieroGlow flasks are handmade scientific glass. Bubbles, slight asymmetries, and variations in gas fill pressure are not defects but signatures of the craft.

• Gas Life & "Ghosting": Noble gases are organic in behavior. Color shifts, "ghosting" (afterglow), and changes in discharge morphology (e.g., a filament turning into a nebula) are normal physical properties of the plasma and are not grounds for return.

• Variable Loads: You understand that different gases (Xenon vs. Krypton) present different electrical loads. A driver tuned for Xenon may run hotter with Krypton. You agree to adhere to the duty cycles and thermal limits labeled on your specific unit.

4. SHIPPING, RISK OF LOSS, & PRE-ORDERS

• FOB Origin: All physical products are shipped FOB (Free on Board) W. NY, NJ The risk of loss and title for such items pass to you upon our delivery to the carrier.

• International Sourcing: For "Custom Commission" or "Pre-Order" items sourced from our international partners (e.g., Zerg Labs, Haloplasma), you acknowledge that estimated arrival times are estimates only. Delays caused by customs, international logistics, or geopolitical events are outside FieroGlow’s control.

• Breakage: We inspect every unit in Massachusetts before final shipment. If a unit arrives broken, you must notify us within 48 hours of delivery with photographic evidence to be eligible for a replacement.

5. INTELLECTUAL PROPERTY

The content on this website—including the FieroGlow™ name, the "Humanitas Lux Primordialis Est" motto, the "Electrical Press" concept, and all original text, logos, and images—is the exclusive property of FieroGlow LLC and is protected by copyright and trademark laws.

• Open Source Exception: Specific circuit schematics explicitly labeled "Open Source / The Electrical Press" may be used for non-commercial educational purposes, provided credit is given to FieroGlow LLC.

6. MODIFICATIONS TO SERVICE & PRICES

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice. We shall not be liable to you or to any third-party for any modification, price change, suspension, or discontinuance of the Service.

7. GOVERNING LAW

These terms and conditions are governed by and construed in accordance with the laws of the State of New Jersey. You irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
